When communicating with employees via their personal phones, organizations need to be cognizant of two important compliance components:

  • Reimbursement for Phone Usage - There are federal and state labor codes that regulate payment to employees for use of their own phones. Many states require employers to reimburse employees for personal cell phone usage when such usage is required to perform their job.
  • Paid Time - Employers may be required to provide “paid time” if communication is intended to be read when the employee is off the clock.
